Woman who birthed 13-year-old boy’s child after raping him avoids prison

After being found responsible for having a sexual relationship with a 13-year-old boy and carrying his child to term, Colorado woman Andrea Serrano of Fountain received a prison sentence.
Serrano admitted that she had a sexual relationship with the minor that led to her getting pregnant and giving birth.
She was given a sentence of 90 days in jail, with credit for seven days already served, despite her attorneys' plea deal proposal that would have let her "plead with her belly" and avoid going to jail.
Serrano will also serve time in jail, be placed on supervised probation for a minimum of 10 years and possibly for the rest of his life, and be compelled to register as a sex offender.
After discovering about the illegal relationship from someone, Fountain Police began their investigation in 2022.
Before accepting the plea deal, the victim's mother complained to the judge about Serrano, claiming that he had sexually assaulted and drugged her 13-year-old son.
The mother claimed that Serrano should be jailed and expressed her frustration with what she perceived as a double standard, suggesting that Serrano would likely face more severe punishments if the genders were reversed.
The mother feels that the plea deal resulted in a lenient punishment of only 90 days in jail, despite the fact that it included a potential sentence of 10 years to life on sex-offender intensive supervision probation and lifelong registration as a sex offender.
She expressed concern that Serrano's punishment sets a poor example for the community and believed that the decision would have been different if the victim had been a young girl rather than a male.
After being granted a one-week delay to ensure the proper care of her children, Serrano is set to start her jail term the following week.
